Stamp duty on a rent agreement: what to check before you sign

A practical checklist for checking rent-agreement stamp duty, registration, payment records, and local requirements before execution.

A rent agreement can involve more than filling in names and monthly rent. Before execution, identify the state where the property and agreement sit, the term, the amount of rent and deposit, and whether local registration or other formalities apply. The agreement itself and the applicable official rules control; a web estimate is only a starting point.

Inputs that can change the cost

  • State and local jurisdiction: stamp-duty schedules are state-specific and may change.
  • Agreement form and term: a lease, leave-and-license arrangement, renewal, or amendment may be treated differently.
  • Rent, deposit, premium, and escalation: the amount subject to duty may not be only one monthly figure.
  • Execution and registration: timing, who signs, and registration requirements can affect what you need to do next.

Use an estimate carefully

A calculator can help you compare scenarios and notice missing details. Enter the state, rent, deposit, and term exactly as they appear in the proposed agreement. Then verify the result on the relevant state authority portal or with a qualified professional before making a payment, issuing an executed copy, or relying on the document.
